Recieved a Civil Summons for debt I can't pay

My husband and I recieved a summons on Jan. 9th for the remaining debt on a property that was forclosed on a couple years ago. They are seeking in excess of $20,000 from us and we have no means to pay it, we have no assests and if we did have them the IRS would be the first to sieze them because we owe a great deal to them as well. Bankruptcy looks like our only option but my husband (along with everyone from the NC office) was laid off on jan. 22nd and we can barely pay our bills right now. I don't work and can't get a job because I am very visibly pregnant. I want to buy some extra time to respond to these people but I only have 30 days to write them back... I don't want this to go any further until I can hire a bankruptcy attorney. What can I do to stall the proceedings?

You can make a motion with the court for an additional 30 days to respond so in effect you have 60 before you have to file an answer. This motion must be made before the original 30 days expires. Usually the folks in the Clerk's office will guide you through the processs. However, the best policy is to seek the assistance of an attorney.
