Legal Question in Real Estate Law in North Carolina

When a spouse leaves the home and has been gone for 12 years and divorced for 8 years of that 12 what rights does the spouse have to the house if the other spouse has been making all the mortgage payment. Does that spouse have right to just move back into the house?

If the former spouse's name is on the deed and you did not settle the property division during the divorce, then yes, they have the right to use the home same as you do. There are legal remedies such as maybe suing for contribution, but that is not a strong claim.
