Legal Question in Real Estate Law in North Carolina

I am an unlimited durable power of attorney for my mother. In May 2007 me and my two brothers had her house put in our names. My oldest brother is having financial hardship. He has been to a lawyer. He was told he could force a sale on the house even though my youngest brother and I do not wish to do that at this time. In my opinion , my oldest brother is adamant about this and wont change his mind. Can he force the sale on this house without the agreement of me and my youngest brother?

Unfortunately if the home was legally placed into several parties names, He can force the sale of his interest in the home, unless the document you used to transfer it to the three of you specifically forbade this. More information is needed to determine if he can force the sale of the entire property. Speak to a real estate lawyer in your area.
