Legal Question in Social Security Law in North Carolina
Legally blind man cannot receive benefits.
I am chairman of a benefit organization for the blind. A former co-worker of mine, who was declared legally blind last summer, has been unable to receive any benefits. He is currently imployed as a tire mechanic at a trucking company full time. He has received a letter stating that he should receive all benefits due to him. After several go-arounds with the local social security office he was mailed a letter stating he is not eligible. He is a hard worker and a proud man, he cannot afford to be with-out income, and therefore, is caught between a rock and a hard spot. Thank you for any help you can offer.

Social Security is a federal program so the rules and regs are the same in all states virtually. So long as he is receiving more that $500.00 in wages, he will not be able t ocollect his benefits. Social Security's definition of disability is "unable to do significant gainful employment" , in other words he can't be able to work at anything. he will ahve t ostop working and drawing a check in order to qualify. Find a good Social Security lawyer in your area. They usually do not charge a fee to talk. It might the best money your friend didn't spend.
