Legal Question in Tax Law in North Carolina

I have hired a full time sitter to watch my children for an average of 15 hours per week at $12.50/hr. She requested cash. Now I am realizing I cannot file this expense on my 2009 tax return because I have not requested anything from her and not provided anything up front. What can I do for the 2009 expenses and what should I do going forward. Are there forms I can fill out for the past expenses or future expenses to allow me to claim some of this childcare expense?
