Legal Question in Traffic Law in North Carolina
If i am coming down a road where road is unmarked and there is parking available for a church on the right hand side. I move over slightly to be in the right side and slow down because it's an residential area. The car behind me stating that he thought i was parking and proceeded to go around me and trigger to get over before the incoming traffic and hit me on the driver side door and tire. Who is at fault?

If they hit you, they are likely at fault - who cares what they 'thought you were doing', they are still required to keep a proper look out and exercise caution when passing.
