Legal Question in Traffic Law in North Carolina

Hit in my brand new vehicle

I was hit by someone who ran a redlight in my brand new Dodge Durango. My truck has less than 1600 miles on it, I have made one payment on it, I am very upset of this accident which is being estimated as far as damages go right now. My question is, I was told that there is a law, I don't know what the name of it is, that has guidelines about if you are in an accident and it is not your fault, and your vehicle has less than a certain amount of miles on it, or you have owned it less than a certain period of time, the negligent party must replace the vehicle if the victimized party so chooses to have this done? Can you tell me anything about this? What the law is called where I can find the entire publication of this law? Or if this law even exists? THank you

Re: Hit in my brand new vehicle

Doesn't exist. The law requires that you be made whole again. No windfall. If your truck is fixable you will get it fixed. You do not get to choose a new truck or a repaired one. Sorry.
