Legal Question in Traffic Law in North Carolina

Do I need a lawyer?

Here is my dilemma; on Jan 26, 1999 I received a traffic violation for speeding, during the traffic stop he had asked if I had been drinking. I told the officer yes so he submitted a BAC test on the field unit. I blew .04 on the machine so the officer could not charge me with DUI.( Six months previous I was found not guilty of a DUI.) However he did realize that I was only 20 years old. My birthdate is on the ninth of February. At the time I was in the Marines. I went to my first court appearance and asked for a continuance, but when my next court date came around I was doing a field exercise and was unable to attend the hearing. So then I was charged with failure to appear. The courthouse told me that I would have to allow them to serve the warrant for failure to appear and bond myself out. I had to leave the country for five months on a deployment, so I was unable to get this taken care of at that time. Since then I have been honorably discharged and moved back to FL but I need to get this resolved in order to renew my FL liscense. So my question is how should I go about this now that I am back in FL?

Re: Do I need a lawyer?

There are two ways you could handle your ticket. You can go back to NC turn yourself in and then bond yourself out and then you will be given a new court date. Then you will have to go back to FL and come back to NC for the court date or hire an attorney to represent you in your absence. I would recommend calling an attorney in the county you got the ticket. There is a possibilty if you hired an attorney you may not have to come back at all to NC. The attorney may be able to get the order for your arrest struck. Please contact us if we can help.
