Legal Question in Traffic Law in North Carolina
My mother was arrested for a DUI in GA while waiting on her NC licence to come in the mail due to a name change (divorce). She still has not received it and NC is asking her to turn it in. What is the punishment since she can not surrender it?

It wouldn't really be fair to punish her for failing to turn in something she doesn't have - now would it? She may however, need to sign a statement to that effect. Of course, her NC license will likely be suspended so if she later receives it, it will be useless except maybe as an ID.
