Legal Question in Traffic Law in North Carolina
An officer charged me with an unsafe lane change indictating that I hit another driver when instead the driver hit me and has now filed with my insurance. How do I prove that the other driver actually hit me instead of it being the other way around?

You will most likely have to file a law suit. I am assuming there are no witnesses other than you and the other driver. If this is the case, it will essentially come down to who a jury or the judge/magistrate believes (depending on which court you file in). In any event, you will need the help of an attorney. Even if you opt to file in small claims court you should still seek the advice of an attorney.
