Passenger seat belt

I was recently issued a ticket while riding in the passenger seat of a car for not wearing a lap belt. The ticket says I ''operated a motor vehicle on a street or highway in forward motion without having the provided front seat safety belt properly fastened about the defendants body (g.s. 20-135.2A)''

My question is about me operating the vehicle, because I was not actually operating the vehicle can I have this ticket dropped because of the officers mistake?

20-135.2A Seat belt use mandatory.

(a) Except as otherwise provided in G.S. 20-137.1, EACH OCCUPANT of a motor vehicle manufactured with seat belts shall have a seatbelt properly fastened about his or her body at all times when the vehicle is in forward motion on a street or highway in this State.
