Legal Question in Traffic Law in North Carolina
speeding and possible dl suspension
Recently, having just returned from India, I was pulled doing 77 in a 55. This is my first offense, in fact, this is the first time I have ever been pulled. What are the chances that my license is suspended for 30 days? What are other possible fines and punishiments? Can I be punished at all if the ticketing officer is not present on the day of my court appearance? Would I benefit at all by requesting a continuance? Thanks for you time.

Re: speeding and possible dl suspension
Usually, it would not be difficult to have that ticket reduced to a 64 in a 55. This would not have any effect on your insurance if it is your only speeding ticket 10 miles over or less in a 3 year period. You will get some drivers license points but not nearly enough to suspend your license if you have a clean record.
Your other option is to ask for a prayer for judgment - again no insurance consequences if it the only one in a three year period for your HOUSEHOLD. But you may want to save it for a future viilation where a reduction wouldn't help (i.e. stop sign).
It is not usually too difficult to get a continuance but in your case I don't see what purpose it would serve.
