Legal Question in Traffic Law in North Carolina
Can I get a ticket thrown out for not knowing the law?
1 Answer from Attorneys
Whether you know the law or not, unless you are a District Attorney or a Judge - you have no authority to 'throw out' a traffic ticket. That said, your odds of convincing a District Attorney or Judge to dismiss a traffic ticket because you did not know the law is basically zero! Most traffic violations are malum prohibitum, meaning your intentions or even knowledge that you broke the law is irrelevant. All that matters is whether or not you in fact violated the law. For example if your speedometer is broken and you believe you are doing 55 but are in fact doing 65 if you get a ticket, the fact that you did not know you were speeding is irrelevant Your best bet is to just hier an attorney to handle the ticket for you! Good luck to you!
