Legal Question in Wills and Trusts in North Carolina
Bought a car took it back within the grace period but they will not return the car we traded in
1 Answer from Attorneys
There is no grace period or cooling off period in NC. The 3-day cancellation period does not apply to car sales. The only exception is if the car dealer has a particular policy, like "you can return in 7 days, no questions asked." Otherwise, if you bought it, its yours.
If you bought it, here are some options:
(1) try meeting with the sales manager to see why you are unhappy and see if they will let you trade for another car to make this a win-win for you and the car dearler; or
(2) go to another dealer and see if they will let you trade for yet another car;
(3) sell the car to someone else.
Do you have a lemon law claim? The lemon law applies to new cars (not used) within the first 24 months' of ownership or 24,000 miles.
