Legal Question in Wills and Trusts in North Carolina
My brother recently passed away intestate in Michigan and I reside in North Carolina. I need a Letter of Administration to manage his estate. Can I be appointed administrator through a North Carolina court or will I have to be appointed in Michigan?
Thank you for your time.

No, you need a Michigan probate attorney. Different states have different rules. It may be that Michigan allows no-residents to serve as personal representative but they might require you to a[ppoint someone who resides in NC to handle the paperwork. It will be best if you get a probate lawyer in the county where your brother resided at the time of his death. That attorney will have the forms needed and will be able to assist you in making sure that things are done on a timely basis and help with an orderly transfer of assets to you or the beneficiaries. If there is another sibling in Michigan, it would be better if that person served as personal representative.
