codicil

as the executrix of my fathers estate do I have to file a codicil that is not legal?

As the executrix of your father's estate, it is your responsibility to take the codicil to the estates division at your county's courthouse and provide it to the clerk. He or she will be able to verify whether it has been legally executed or if it will not be valid. If it is found to not be legal, then the clerk may include a copy in the estate file, but it will not dictate how the estate is handled.
