Legal Question in Wills and Trusts in North Carolina
distribution of assets in will
In my ex-husband's will, my son was left an old sports car, a 1965 Alfa Romeo convertible, that does not run. The executor of the will states that the car must be sold for at least $1500 to help pay off debts owed by the estate. No money is owed on the car. My son believes he should get the car as stated in the will. Who is right?

Re: distribution of assets in will
It is unclear if this is a WA case or a NC case. If it is a WA probate the estates debts must be paid before other distributions of probate assets. I would expect the car would be a probate asset.
