Legal Question in Wills and Trusts in North Carolina

estate check

My grandfather died (April 03 in NC). My mother (his daughter) died

Aug 03 in MI, before his estate was settled. My dad received a check in

November 03 for $150,000 made out to the ''Estate of my mom''. What

are my dad's options? Does he Have to go through probate? Does he

need a lawyer? How much time will this take? How much money will it

cost?

Re: estate check

It sounds like your father will need to open an estate for your mother in MI. Were your parents seperated or divorced when she died? Did she live in MO and just pass away in MI? I am trying to understand how Dad lives here and Mom was in MI. It could make a difference.

If you made a type-o and when you wrote that Mom died in MI, you meant MO, that makes a difference.

Until we know where your mother's estate should be, it is impossible to determine the time or cost required.

Good Luck,

Tony Smith
