Legal Question in Wills and Trusts in North Carolina

If you own homes in North Caroline & South Carolina does it matter which state you create your will and heathcare proxy. Thanks for your help.

Yes. There can be many residences but only one domicile. You should create a will and power of attorney in your state of domicile.

Domicile is where you hang your hat so to speak. Where do you vote? Have a driver's license? Spend most of your time? Pay income taxes?

If it still is a toss up, then find out about each state's probate laws. And if it is likely for you to still own property in multiple states at the time of your death, then maybe what you need is a revocable living trust, pourover will and health care and financial power of attorney.
