intestate
if someone dies without leaving a will and has no children who would be the next to inherit ? would it be the sister ?

It depends on who is alive. If no children, are there grandchildren? Is there a spouse? Are parents alive?
How many siblings does the decedent have?
If there is no spouse, no lineal descendants and no parents alive, then brothers and sisters would be the next to inherit.
