Legal Question in Wills and Trusts in North Carolina
Do life insurance payouts with named beneficiaries go to the estate? What about Joint-owned automobiles? What else would be considered part of an estate?
My husband recently passed and he & I own autos jointly but credit cards were in his name - they're trying to talk me into paying. Just trying to figure out if there will or should be an estate or not.

It sounds like you should open up an estate whether or not there are enoguh assets to pay it since there are claims. I would talk with an estate attorney in your county. Assets that go directly to a beneficiary are generally not part of the estate. Some assets can be brought back into the estate to pay claims. Too much detail to go into but while the credit card companies may very well be out of look, you should consult with an estate attorney in your area.
