Legal Question in Wills and Trusts in North Carolina
I live in North Carolina. My neighbor just lost his wife to cancer and he is so afraid that he is going to lose his house and cars. Is he not protected in any way?

I cannot discuss your neighbor's legal issues with you for ethical reasons. I don't understand the relationship. Why would loss of a spouse translate into loss of car and home? How are the assets titled? Did the spouse have a will? Are the assets encumbered or paid for? Are there outstanding debts, like medical debts? He may be liable for those. Can he pay? Or not? If not, he may have to file bankruptcy if they are very large. Is this credit card debt just in the wife's name? Then the answer is yes, he is protected and doesnot have to worry.
I don't want to alarm your neighbor, but there are just too many unknowns here and no lawyer can be expected to answer the question as you phrased it, I need to know your neighbor's circumstances in order to better advise him as to whether he needs to take action or will be fine.
Have your neighbor contact me if he is interested. I give free 30 minute consults by phone or via email.
