Legal Question in Wills and Trusts in North Carolina

Mom passed away 4/16/10, as executor (son) I have been sent the paperwork for transfer of stock to my name. Her will states to divide 50/50 with my brother. Can this be done that simply or does the stock have to be listed in the estate of my mom..

Have you been appointed, not by the will, but by the court as the executor? Filed your inventory? Accounted for the value of the stock in the inventory? If the will says that you are to split this with your brother, then you must do that, but first you have to account for the value in your mother's estate.

The fact that you are asking these questions tells me that you do not have a probate lawyer for the estate. Find one. There are many t hings that you have to do and a lawyer will help insuree that they are done correctly.
