regarding probate on an estate: if the 2008 car is in both spouses names, does the car have to be considered in probate court? or does the surviving spouse only need to go to the dmv and get the title in her name? thank you,

It depends on what assets are in the estate and what claims there are. If there is not much, the surviving spouse can get a letter from the probate court that she is claiming the car as part of her yearly allowance. The clerk will give her a paper to that effect which she can then take to the DMV so that she can get the car titled in her name.
