Legal Question in Wills and Trusts in North Carolina

How to recover debt from deceased parent?

My Dad died recently owing me $6000 and intestate. His girlfriend arranged memorial sevices and disposed of all assets, and tells me that I am due nothing. I had asked her to file with the Clerk of Court as Administrator of his Estate, but she refused. Do I have any recourse? I have the loan agreement from my Dad in writing.

Yes, go to the clerk's office of the probate division and request to be appointed administrator of the estate, and then begin using your power as administrator to begin investigating(and perhaps, prosecuting) the girlfirend for fraud, misappropriation of estate assets and who knows what else.
