Legal Question in Wills and Trusts in North Carolina

Any time limit between filing and distribution to heirs?

My ex-husband's father died in 1998 leaving half of his estate which consisted primarily of his home and property to my 4 children. ( Their father had died in 1996.) Soon after, they recieved a letter form their aunt, who is executor, of some steps she was taking to prepare the house for sale. They have heard nothing in the last several years. What should they do?

The first thing to do is call the probate court in the county where he lived and see if a probate proceeding is pending. If not, and if there isn't such a proceeding which is already finished, someone should ask that aunt for an explanation.

Ordinarily a widow has a right to stay in the house during her lifetime, and that might be why the house hasn't sold.

There are enough possibilities that it would pay for you to hire a lawyer just to look into it for you.
