Legal Question in Wills and Trusts in North Carolina
vehicle title transfer inherited from another state
Inherited my father-in-laws vehicle upon his death(Ohio resident) it was bequeathed to me. He left all his property in a trust although vehicle was still in his name. My brother-in-law(trustee) tells me that nothing needs to be filed in Probate Court. North Carolina DMV says it requires an order of some kind signed by a Probate Court to effect title transfer to me in NC. The only document sent to me by trustee was copy of page appointing my brother-in-law as trustee. He signed the title over to me as trustee. At this point NCDMV will not accept this and I cannot get the title transferred. What should I do? Not sure what kind of trust it is but assume a ''Living Trust'' since that seems to be the only one that avoids probate.

Re: vehicle title transfer inherited from another state
If it was a Living Trust, then maybe the problem is that he never transferred the vehicle into the Trust prior to his death. In other words, if it was titled in his name, then it would pass through his estate.
