Legal Question in Wills and Trusts in North Carolina

no will

my stepfather justed died in NC. He left no will because he assumed if he didn't everything would go to my mother. His two children from a previous marriage wants all his estate. He made it very clear that he did not wish to leave them anything but NC law saying they are entitled. The home my parents lived in was a gift from my uncle but only has my stepdad's name on the title, will his children get the house?

That is unfortunate but the children do have certain rights to the property as does your mother. I would suggest your mother consult with an attorney immediately as to her rights to the property (there may be certain time limitations for certain things). She may have certain lifetime rights.
