It is difficult to tell what kind of case you are referencing? Workers' compensation? Social Security? Long-term disability? They can all be different.

In workers' compensation cases, the attorney will usually take a 25% fee from the end settlement, unless certain exceptions apply, which include, but are not limited to, the following: winning a denied case in court, preserving on-going benefits to claimant after threatened termination, lump sum settlement unlikely in the future, or for other sigificant work done in the claim. In this case, usually the attorney will take every fourth check per month.
