Legal Question in Workers Comp in North Carolina
Denyed Authorization
My W C case manager denied authorization for a second surgery for knee injury, they refused to send Dr. written response or details. Can they deny me a response because they will not return my calls.

Re: Denyed Authorization
Not sure I fully understand the question, but you have the right to either file a motion with the Executive Secretary/Deputy Commissioners at the NC Industrial Commission requesting an Expedited Order that the surgery be authorized, or file a Request for Hearing on a Form 33 with the NCIC seeking the same relief. Document your case with good medical opinions and context facts.
You can get a copy of the Form 33 from our website at ncworkcomp.com in the Resource Library. Also read the NCIC Bulletin and file a Form 18 as well if you have not done so already. Speak with an experienced attorney for more detailed help. Good luck!

Re: Denied Authorization
I don't think they have to give you details, but at this time, you should seriously consider hiring a workers comp lawyer to represent you. Feel free to email me directly, and I'll be glad to refer someone to you.
