Legal Question in Workers Comp in North Carolina
My mother fell on the job. She broke off two teeth & broke a bridge in her mouth. Her job is saying her leg gave way. They are denying her claim. She is 82 years old & still working. Would her age make a difference? And is there anything she can do.

In North Carolina, if she had an accident at work, assuming other elements are in place, she is entitled to workers compensation benefits. Does the doctor weigh in on how she fell? I ask because if the doctor says that her legs were weak and they just gave out, then there may be a problem with proving the accident. However, if she slipped on something, fell from fatigue from working too much, tripped over something, etc, then the fall is covered under workers' compensation laws. If she has not done so, have her file a form 18 and turn it in to the Industrial Commission. This form can be found on the Industrial Commission's website.
