Legal Question in Workers Comp in North Carolina

Seeking Advice

I was injured at work on June 27,2007. i have been out of work and on workmans comp for the past two months. I have been to a back specialist that the workmans comp worker told me I had to go to and he says there is nothing wrong. The problem is I am still having sever back pain, tingling in my arms and legs, stabbing pains in arms and legs, weak sensations and numbess. I can not be on my feet for more then 2 hours without having excruiating back pain. My question is can I get a second opinion from another doctor or do I have to go by what this doctor says? I think if there is nothing wrong with me I should not be in pain all the time. Can someone please help me? I have worked for this company for 9 years and never got hurt on the job. Thanks.

First make sure you have filed a Form 18, reporting your injury, with the NC Industrial Commission. You can get a copy of the form on their website, as well as a Bulletin and Form 33.

Once your claim number is assigned, and form 18 filed, write the Executive Secretary's office about your need for additional medical care and second opinion with a specialist. She should grant your request and make workers' comp pay for the visit and any treatment recommended.

The Industrial Commission can allow you a second medical opinion. Go to ncworkcomp.com, click on links and select the Industrial Commission. You should contact the Executive Secretary's office. Consider getting an attorney ASAP.
