Legal Question in Workers Comp in North Carolina

Stopping WC checks without notice

I have been on WC for three months. I have been receiving weekly payments. Can my WC insurance co. just stop payments without notifying me?

Re: Stopping WC checks without notice

Assuming they are paying you (as they should) pursuant to a Form agreement (either Form 60, 21 or 63), they must get permission from the NC Industrial Commission before they can terminate your benefits via a Form 24 telephone hearing with you or your attorney. Make sure they have filed the Form 60, 63 or 21, as it is required they not pay anyone without one of the three being on file at the IC.

Also, go to the NCIC website, from the Links page on our site at ncworkcomp.com, to get a Form 18 to file before the 2 anniversary of your injury, as well as a Bulletin, which explains the system and benefits available. Consult an experienced attorney if you feel something is not going right. Good luck!

No they cannot. But if they should stop payments, the reason for stopping the payments would dictate what their responsibities are for any notice requirements. Did they stop paying you? [email protected]
