Legal Question in Workers Comp in North Carolina

I have been on worker comp. for approx. 3 yrs and am now rated at 25% disabled in my right shoulder. My doctors have released me to find a job with restrictions. If I find a job, with a massive pay cut, and refuse to take it can worker comp. stop my checks?

If you refuse suitable work, the Industrial Commission can allow the workers' comp insurance carrier to stop your checks. The issue is what constitutes "suitable work." That is a complex matter which has resulted in many decisions over the years. Folks who do not have a lawyer are frequently abused. You are walking through a legal minefield. Get a lawyer NOW!

You have a right to a second medical opinion on the rating, which could result in different work restrictions. The Industrial Commission has adopted Rehabilitation Rules. You must become familiar with them. You should keep a written record of all jobs you have applied for so you can show a reasonable effort on your part.
