Legal Question in Workers Comp in North Carolina
Worker Comp
On Oct 22nd 2008 I was at work and I hurt my arm. I returned to my terminal & told my supervisor that I hurt my arm and that we may need to fill out an injury report. He said lets get these trailers loaded and then talk out as the night went on he had an extra road run he needed filled so be low man I had to take it which meant I returned after he was gone. I worked Thursday and Friday thinking maybe its just a pulled muscle then Monday at work halfway through my shift I told my sup again to which he answered again after we get these trailers loaded once we were finished we sat down and talked he asked me what date he thought it was the 24th and I said no it was the 22nd then he said oh that too long if we turn it in now our employer would punish both of us and deny the claim I was pissed I said fine I'll say it happened at home and left. I am still about 1- 1.5 mo's from returning. At first I didnt push the issue because I liked my sup and didnt want him to get fired. Can I do anything?

Re: Worker Comp
You need to file a Form 18 with the North Carolina Industrial Commission and employer ASAP! Remember to keep a copy for yourself. Also, get a Bulletin and Form 33 from the IC as well. The Bulletin will explain how the system works.
You may or may not have a compensable case, depending on the facts, as most arm injuries require an accident-type event. See our site for more info/link to Industrial Commission website. Our site address is ncworkcomp.com.
