Legal Question in Workers Comp in North Carolina
Is worker comp responsible?
I blacked out at work, I hit my head on a hand rail and fell on my leg and knee twisting them. I called in this morning asking that an accident report be filed and was told workers comp is not responsible because I blacked out. It happened at work and I was on the clock who is responsible?

Re: Is worker comp responsible?
The facts you have given indicate the black out caused the fall. If the black out was due to a non-work related (idiopathic) condition, it is not an injury by accident or occupational disease covered by workers' comp.
If the black out was more likely than not caused or aggravated by some unusual work condition, it may be covered. This is a medical issue.
