Legal Question in Workers Comp in North Carolina

Worker not covered?

We started building a house ten months ago. Our builder has several guys on his crew. Near the end of the job our builder had a guy that used to work for him come over one Saturday to help finish the trim. He just wanted a few extra dollars. This guy is employed full-time elsewhere. The worker placed a ladder on top of the scaffold and tried to climb it to the tallest peak of our house. He fell and broke both legs. He claimed full responsibility and told us it was 100% his fault. He tried to file his medical bills on his medical insurance and they denied him, claiming our workers comp. is responsible. He only worked that half day before he fell. Are we responsible? Can his insurance deny him?
