Legal Question in Workers Comp in North Carolina

Worker's Comp attorney??

I work out of a union hall in Ohio. At the time of my injury, I was working in the state of West Virginia and I am a resident of North Carolina. Where do I need to obtain an attorney from in order to handle my case?

Was your contract of employment made in NC, is your principal place of business in NC, is your employer's pricipal place of business in NC? If you answered positively to one of these, you can file a claim in NC and NC can exercise jurisdiction over the claim. You need to file the claim within 2 years of your injury date with the NC Industrial Commission. You can get to their website via our links page at ncworkcomp.com.

WV and OH may have the ability to process your case also. Once you decide which states can exercise jurisdiction, then you are required to determine which state pays the better benefits under wc. Each state is a little different.
