Legal Question in Workers Comp in North Carolina

Worker's Comp

If my employer was paying my health insurance before my injury, will they continue to pay it while I am out of work due to my injury? Also, if I have dental and life insurance taken out of my check, am I responsible for paying it out of my pocket during my time out of work due to injury?

Re: Worker's Comp

My experience has been that it largely depends on the employer. Some federal laws apply, like FMLA that protects your job for 12 weeks if employer is big enough. COBRA also requires them to offer you extended health insurance benefits after you are seperated from employment for up to 18 mos. The ADA protects the disabled in the workplace. Go to the EEOC website for more information and consider speaking with an employment law specialist. Also, check you Personnel Manual or Handbook, and call your HR Department to be certain. You can get a link to the EEOC from our links page on ncworkcomp.com. Good luck!
