tax prep error

A major tax service transposed the SSN's for my 2 dependents, causing a rejection of an anticipation loan as well as of my return. I have since asked for my initial fees back, as well as the fee for the anticipation loan, but they are so far unwilling to directly issue me any monetary compensation. I live in Fargo, ND and have been living through a major disaster during this time with 2 year old son and fiance. I still don't have the money from my return, now have to wait for check in mail after amended return. Do I have a right to my fees, and is there any compensation I can go after for interest or emotional distress? I've lost countless nights of sleep worrying that I wouldn't be able to feed my family, let alone evacuate the city if need be...that was the reason for the anticipation loan in the first place. As well, there was a credit inquiry done for the anticipation loan, however it had no chance of every going through because of the mistake on the return. I have a letter stating that was the reason for the denied loan. Can I have them get the inquiry off my credit report?

Under some circumstances, this can amount to negligence and possibly consumer fraud.
