Legal Question in Criminal Law in North Dakota

I need help

My husband has been held in jail for four months he was accused of statutory rape i was told they didnt have enough evidence so they lowered it indecent liberties to a minor i dont understand if they didnt have enough evidence how can they give him another charge and continue to hold him they still want to try and convict him of something all they have are statements please help me

The State can charge and hold him on bail for any charge for which they have probable cause to proceed. I don't know the details of the case but I would guess he is plea bargaining to a lessor charge. But I am guessing. I hope he has a lawyer.
