Legal Question in Criminal Law in North Dakota
Identity theft
In 2000 a relative or someone associated with her was arrested in North Dakota and gave my name and date of birth as being theirs. There is now a warrant in my name in North Dakota. I found out in 2005 of the situation. This relative has used my name before in California but it was caught very early. According to police no fingerprints were taken and the crime happened on a military base. I live in California and have never been to or lived in North Dakota. What can I do to clear my name?

Re: Identity theft
Contact an attorney in the city in which the incident occurred and have the attorney contact the local law enforcement agency to find out what information they need to recall the warrant in your name. Then investigate to determine where this relative was at the time the incident that caused the warrant to be issued occurred. The FBI may be able to assist you in this because of the identity theft. Start accumulating evidence as to where you were at that time.
