Legal Question in Criminal Law in North Dakota
Loud party (Court date in a few days)
I live with 5 roommate, and it was one of their birthdays. I am 21 years old, but most of the people were minors. I had expressed to my roommate the previous night that I was uncomfortable with having minors at the party, but I was not able to stop the party from happening. The police gave everyone (except 2) loud party citations, and many of them minors. I was the one who talked to the officer and cooperated with him. One of the roommates was sleeping in his room with his 21-year-old girlfriend. The officer didn't even ask him to get out of bed; he got away scotch free. His girlfriend was allowed to leave (also scotch free) after the officer found that she was not a minor. At the end of the night, the officer charged me with a loud party citation as well as a minor. It wasn't until I told him that I was not a minor that he said he made a mistake and crossed out the minor. However, he had my ID the entire time he was there. How should I plead next week? If not guilty, how should I argue to dismiss the loud-party citation? Thank you very much in advance for your time.

Re: Loud party (Court date in a few days)
You can plead guilty or not guilty. I would be careful that the prosecutor doesn't additionally charge you with "contributing to the delinquency of a minor." A more severe charge, you may possibly already have that charge coming.
If you plead guilty to loud party the maximum penalty is $500, without the possibility of Jail.
