Legal Question in Criminal Law in North Dakota

Possesion of Marijuana

My son was with a friend who borrowed a car from his sister. They took the car to talk to a guy she had just got into a fight with. She called the police and reported that this guy had assaulted her. The police followed my son and friend and while they were talking to the guy at his work, the police searched the car with the sisters permission. They arrested my son and friend after they found a little over an ounce of marijuana in the car. They were arrested because they were the last occupants of the car. He was charged with possesion and assigned a public defender. His bail is set for $3000 and ordered he could not buy a bond because he lives with us out of state. He has been in jail for 3 weeks and hasnt seen a police report. His trial is Mar 24. His public defender said he is waiting to see where the state stands before asking for a bond reduction hearing. How long should it take for the police report? He had no knowlege of the marijuana in the car. Should he plead not guilty or plea bargain?

Re: Possesion of Marijuana

He should plead not guilty. He should wait and let his attorney advise him of his options, and then make a decision whether it is better to go to trial or negotiate a disposition.
