Legal Question in Criminal Law in North Dakota

suspended from job of 5 years/over 20yr old felony

The company I work for(5yrs) made a new policy effective the 1st of the year stating if you ever had a felony can not work there,the old policy made you note it After 10 years.my felony was a first time theft charge 20years ago while I was in high school, I paid restitution & all jail time was stayed & had 15 months supervised probation,I have 30 days to get this fixed,I live in North dakota---HELP

There is no way to expunge this conviction completely from your record in North Dakota. Was the conviction in North Dakota?

However my guess is that you were convicted of a Misdemeanor by disposition. (I would have to see the judgment from the court to determine) If you indeed plead guilty to the felony, but was sentenced to less a year all suspended, under ND law you are deemed convicted of a Misdemeanor.

The law that controls this disposition is North Dakota Century Code � 12.1-32-02(9)
