Legal Question in DUI Law in North Dakota

3rd offence DUI

My boyfriend recently received his 3rd DUI in Fargo, ND. Cass county. What is the punishment for this, could he prevent jail time if he requests to take a breath test everyday. He's a good person who happened to hit rock bottom and now is getting the help he needs. He attends AA, is living with his folks who's home is alcohol-free. Would it benefit him at all to talk to the judge about this? Is it possible he would get a chance without having to sit time in jail? He is trying to move on with his life and is serious about his sobriety? Any advice?

He is facing 60 days in Jail if he pleads guilty. I assume he was also charged with Driving under suspension? I recommend you contact an attorney to see if there is something that can be done.
