Legal Question in DUI Law in North Dakota

My son had a accident and got a minor in consumption blew a 0 on breathalizer and the cop was questioning my son without a parent present. Is this legal in north Dakota?

I suspect your son admitted to drinking, and a Police officer can question a driver at the scene of an accident. If he was taken into custody they would have to contact a parent if he is under 18.
