writing a novel about dead celebrities

can i freely write a novel about dead celebrities that may stray from the facts of their lives--i.e. can i write a book that has a gay president eisenhower w/o being sued?

You need to contact a ND lawyer to find out the ND law on celebrities. Generally, you can do this if you make it clear that this is ficitional and not intended to suggest that Eisenhower was gay or that you and your book are not associated with nor sponsored by Eisenhower's survivors.
