Legal Question in Family Law in North Dakota

my boyfriend signed the parent thing in the hospital saying he is the dad of our baby he is on her birth cerificate. he passed away now his parents are saying he is not the dad and that they did a dna test to prove it. she gets his social secerity can they take this from her

Part of this depends on timing. If he was considered her father for several years it is unlikely they could change that parent designation.
