Legal Question in Landlord & Tenant Law in North Dakota

paid a security deposit of 400.00 and signed a one year lease agreement.

I am going to be moving back home so I spoke with my landlady lastnight. She just showed my place this morning (that was fast) and the guy is going to move in on the 25th of October, 2010.

As long as I clean the place (I have only been there since August 28th, 2010) shouldn't I get my deposit back? The new tenant who is moving in is paying a deposit, so if they keep mine they would have two deposits on the same apartment.

Please advise and thank you

If the apt is in the same condition you should get it back. Unless the apt is going to be empty for any period of time, they could keep it as payment of rent.
